Service Agreement

1. Parties

1.1. This agreement is made between QZ TEKNOLOJİ A.Ş. (referred to as quickzone) providing the services listed in the services section and the person/institution specified in the New Customer Registration section (referred to as Customer), for the use of the website operated by quickzone at https://quickzone.net (referred to as the Site) and the services to be purchased through this site, under the terms and conditions specified below.

1.2. The parties declare, accept, and undertake the accuracy of the information written in this agreement.

2. Subject

2.1. This agreement will regulate the parts that the customer is allowed or not allowed to do according to the information provided during registration, preferences in their orders, fees to be paid to quickzone in exchange for the services received, and the rights and obligations arising from the service relationship between the parties. The descriptions of these services and processes are as follows.

2.2. Membership information is the information entered by the customer during registration. Since these details are used in transactions, it is assumed that the customer and member have entered this information accurately, completely, and correctly.

2.3. quickzone may require the sharing of contact information such as email and phone number during registration, purchase, or similar processes for notifications, sending newsletters, or implementing security protocols, and may request verification through methods such as confirmation codes, making these verification processes mandatory for using the services.

2.4. quickzone may use the contact information shared by the user during registration to send notifications or newsletters regarding the services.

3. Responsibilities

3.1. quickzone will provide the services ordered by the customer upon request. quickzone will confirm the receipt of the order and undertake to provide the service specified in the order upon collecting the relevant fee.

3.2. Payment method and VAT differences will be stated with the total amount to be calculated during the order, and quickzone will inform the customer of the fees to be paid according to the customer's monthly or annual payment preferences.

3.3. The service will commence after the acceptance of the order and confirmation of the transactions. Responsibility for the accounts and passwords lies with the customer, and the customer will be responsible for any damages arising from these matters.

3.4. The customer undertakes to comply with the statements and warnings provided by quickzone as part of the services received. The customer agrees, accepts, and undertakes to comply with all warnings or notifications published by quickzone while benefiting from their hosting account. The customer may not distribute, sell, or share the hosting services provided free and unlimited to them, whether for a fee or free, limited or unlimited, to third parties.

3.5. All communications between the customer and quickzone through live support, support requests, email, phone, written, and verbal are private and confidential. They cannot be shared without quickzone's permission and approval.

3.6. The customer undertakes not to access files or programs they are not authorized to access using software and programs within the service, not to create any issues due to such problems, and to cover any damage and problems that may arise.

3.7. The customer acknowledges and undertakes that they are responsible for and will cover any taxes, duties, and similar obligations applicable during the use of domain names, hosting, or services, whether currently in force or coming into force during the contract period.

3.8. The customer accepts and undertakes that they are responsible for all files, content, and programs hosted within the service, as well as all operations related to websites and email services. They also undertake to cover all legal and criminal liability arising from any violation of laws by such data, information, and statements. quickzone cannot be held liable for any faults arising from this issue. quickzone does not review, verify, or assume responsibility for pages created by users before sending them. quickzone may terminate user accounts for violating these terms or for other reasons or if quickzone believes it harms its own or its users' business. quickzone has the right to delete any illegal actions and deeds once it becomes aware of them, without notifying the customer.

3.9. quickzone cannot be held responsible for any material or moral damages arising from the contents of customer data within the provided services, erroneous or malicious use of these contents, or email data sent and received. The responsibility for backing up and storing all data primarily belongs to the customer. quickzone backs up customer services in web hosting, reseller hosting, and virtual server services at regular intervals, but this backup service is provided unilaterally by quickzone without additional charges and the relevant data is not guaranteed. The customer cannot hold quickzone liable for any errors, material or moral damages that may arise from interruptions or data loss in their services.

3.10. quickzone will carry out domain registration transactions for domains ordered and paid without any issues. The owner of the registered and paid domain name is the customer. quickzone will be able to process requests related to the domain name based on the customer's requests. The customer must request any modifications, changes, or transfers of the domain name as soon as possible.

3.11. quickzone's liability for the services provided is limited to the monthly fee for the service. In the event of interruptions or disruptions in web hosting, reseller hosting, and virtual server services that exceed the committed monthly period, the duration of the interruption will be added to the customer's service free of charge. The compensation claims for any disruptions, issues, or damages in the customer's services cannot exceed the monthly fee of the service.

3.12. quickzone will show due care and diligence in maintaining backups of the customer's data, but cannot be held responsible for data loss due to any issues. The customer is responsible for regularly backing up their own data.

3.13. quickzone specifies the special usage conditions for the products and services it provides on the web page prepared specifically for each product and service. Users are deemed to have accepted these conditions when they purchase the services.

3.14. quickzone may make changes to the products and services it provides over time without prior notice.

3.15. The customer is obligated to use the services they receive in a manner that does not harm other users. quickzone may warn the customer and request corrections in cases of such usage or may temporarily suspend the service without notice.

3.16. The customer agrees that all resources labeled as unlimited in the services used are considered unlimited as long as they are used in good faith and in accordance with general usage conditions. In cases of excessive use of server resources or use of resources for purposes other than intended, quickzone may warn the customer and request corrections or temporarily suspend the service without notice.

3.17. quickzone may decide to terminate the service without any conditions regardless of the content and scope of the product and service. In this case, the remaining balance from the service and product will be refunded to the user. If the customer does not accept the refund or does not respond to the relevant notifications, the balance will be reflected as a credit in the customer's account.

3.18. quickzone reserves the right to stop, fully cancel expired domain names, hosting, or other services after the expiration date. quickzone is not obligated to retain any data records after the cancellation of expired or unpaid services.

3.19. quickzone complies with the conditions of ICANN and domain name primary coordinator YAZMAN (REGISTRAR) companies for domain registration services. All responsibilities and processes are subject to the conditions of YAZMAN (REGISTRAR) companies. Domain registration processes are managed by software systems operated by quickzone and registrar companies. The customer is responsible for the entire process in case of any errors or access issues during this operation.

3.20. Domain registration, renewal, or modification processes are carried out through third-party software or manual processes. In case of errors arising from such processes, the customer is obligated to share these notifications with quickzone if they notice the error or if they are notified by the registrar company. Otherwise, quickzone is not responsible for any disruptions, damages, or losses.

3.21. quickzone shares customer information with the Domain Name Operator or intermediary company as it is mandatory for domain registration services. The responsibility for changing and verifying WHOIS information, domain registration password, and transfer lock lies with the customer. According to ICANN rules, quickzone or domain operators may suspend the domain name due to unverified WHOIS information. quickzone may request documents to verify WHOIS information.

3.22. In domain operations such as registration, transfer, renewal, WHOIS, domain name server (NS) updates, and status changes, quickzone applies the rules and agreements of the registration operator (registrar) and related ICANN rules. These rules may change over time. The user is deemed to accept all possible changes to this agreement and rules.

3.23. In domain name dispute resolution, quickzone acts in accordance with the rules of the registration operator (registrar). For domains such as .com, .net, .org, the UDRP process required by ICANN rules may be applied. The user accepts that these provisions and processes may be applied in domain disputes.

4. Contract Duration and Termination

4.1. The contract starts when the customer completes the payment for the services and continues until the end of the service period selected by the customer. The user can terminate the service at any time with prior notice before the service period ends.

4.2. quickzone reserves the right to terminate the contract unilaterally and without notice, without any compensation obligations, in cases of abuse of the service, violation of the terms of use, or failure to meet payment obligations.

5. Force Majeure

5.1. The parties are not liable for failures or delays in fulfilling their obligations under this contract due to force majeure events such as natural disasters, war, terror, riot, strike, lockout, etc.

6. Dispute Resolution

6.1. Disputes arising from this contract will be resolved according to the laws of Turkey and under the jurisdiction of Istanbul courts and enforcement offices.

7. Miscellaneous

7.1. quickzone has the right to amend the terms of this agreement unilaterally and without notice. Amendments will be effective as of their publication date.

7.2. The customer accepts that any notifications made by quickzone regarding the services may be sent via email, text message, or any other communication method used by quickzone.

7.3. The invalidity of any provision of this agreement will not affect the validity of the remaining provisions. The parties will negotiate in good faith to replace any invalid provisions with valid provisions that reflect the original intent of the invalid provisions.

7.4. The customer agrees and acknowledges that they have read and understood the terms and conditions of this agreement before accepting it and using the services.
